NOTICE OF ELECTION OF PRESIDENT, EXECUTIVE VICE PRESIDENT, 2ND VICE PRESIDENT, SECRETARY-TREASURER, RECORDING SECRETARY, (2) SERGEANT AT ARMS, (3) 3-YEAR TRUSTEES, (23) DELEGATES TO D.C. 37 AND (10) DELEGATES TO CENTRAL LABOR COUNCIL OF LOCAL 372, NEW YORK CITY BOARD OF EDUCATION EMPLOYEES, DC 37,  AFSCME, AFL-CIO (“LOCAL 372”)

Notice is hereby given to all members of Local 372, N.Y.C. Board of Education Employees, DC 37, AFSCME, AFL-CIO (“Local 372”) that the date has been set for Election of the President, Executive Vice President, 2nd Vice President, Secretary-Treasurer, Recording Secretary, (2) Sergeant at Arms, (3) Trustees, (23) Delegates to D.C. 37, (10) Delegates to C.L.C. of Local 372, New York Board of Education Employees, DC 37, AFSCME, AFL-CIO. The terms of office will be (3) Three Years, from June 2023 to June 2026. The Election is to be conducted in accordance with the provisions of the Constitution of the American Federation of State, County & Municipal Employees (“AFSCME”), AFL-CIO, AFSCME’s Local Union Election Manual, Local 372’s Constitution and any rules established by Local 372’s Election Committee (“Election Committee”) as long as the Election Committee’s rules do not violate any of the above-mentioned Constitutions.

ELECTION

The election will be conducted on WEDNESDAY, JUNE 7, 2023 from 9:00 AM to 9:00 PM at multiple polling sites listed on Page 2. The Election will take place for the offices of President; Executive Vice-President; 2nd Vice-President; Secretary-Treasurer; Recording Secretary; (2) Sergeant At Arms; (3) 3-Year Trustee; (23) Delegates to District Council 37 and (10) Delegates to the Central Labor Council. The terms of office will be for three (3) years from June 2023 to June 2026.

The Election for the offices referenced above will take place on Wednesday, June 7, 2023 from 9:00 AM to 9:00 PM at multiple polling sites (as per Local 372’s Constitution) listed on Page 2 of this notice. The voting will be conducted by an independent election company and it will be by secret in person paper ballot. Pursuant to Section 2(F) of Appendix D to AFSCME’s Constitution, all members in good standing will have the right to vote. The ballot will be designed to enable a member to have the option to vote for a full Slate of Candidates (Slate has a Candidate for every position on the ballot) or for Independent Candidates.

Members will be able to cast their votes at any one of the polling sites listed on Page 2 of this notice however once he/she cast his/her vote at one polling location then he/she will not be able to vote again in any location. When a member enters the polling site, he/she will be required to present his/her union Membership I.D. Card or Photo Identification Card, such as a Driver’s License or any other acceptable form of Photo Identification Card to authenticate the identity of the member as the individual whose name appears on the Voter Eligibility List. If an individual is in Agency Fee Payer status, he/she will be asked to fill out a Change of Status Card (Green Card) and submit it to the election company representative and then he/she will be able to cast a vote. If an individual is not in the eligible voters list, then ONLY the valid photo I.D. will be accepted and he/she will cast a Challenged Ballot until membership status of this individual is confirmed. The member will be directed to one of several voting booths, at which time he/she will vote. After the Member has voted and placed the ballot into the ballot box, he/she must immediately exit the polling site.  There will be no absentee ballots. Write-in ballots are not permitted.

Each candidate is entitled to have an Election Observer present at the polling site for the duration of the voting, and at the location where the vote tally is to be conducted. An observer must be a member in good standing with AFSCME. A candidate may not act as his/her own observer or as an observer for another candidate during the actual voting. Candidates are asked to submit the names of their observers in writing to the Election Committee Chairperson, by Wednesday, May 31st, 2023 or the day of the election, observers can bring the Official Observers Form signed by the actual candidate to the polling site where they will be observing and hand it over to the election company representative. Observers will be required to present identification before they are allowed to observe. The maximum number of observers per candidate or slate of candidates at any particular time shall be one.

The tally of ballots will be conducted on WEDNESDAY, JUNE 7, 2023, immediately after the polling sites have been closed. The tally will be conducted at Local 372’s Headquarters, located at 20 West 33rd Street, 8th Floor, New York, N.Y., 10001, in the Meeting Room. Candidates may and are encouraged to observe the tabulation.

DISTRIBUTION OF CAMPAIGN LITERATURE

In accordance with AFSCME’s Constitution and AFSCME’s Local Union Election Manual, any Nominee or Announced Candidate for elective office shall have the right once prior to the election, to have mailed through the Union office, but at the Nominee’s or Candidate’s expense, campaign literature. Any Candidate who wishes to mail campaign literature must furnish the Union with copies of his/her literature. The candidate must also furnish or pay for the envelopes, affix the stamps to the envelopes or pay the money for the mailing meter charge. The Union or its authorized mailing service will address and mail the materials. Candidates will be required to make an advanced payment to cover the entire cost of the mailing and addressing process. Candidate distribution requests will be honored in the order received. The candidate is not entitled to a mailing list for his/her own use.

                                                            ELECTION PROTESTS

Any Local 372 member in good standing may protest the conduct of the nominations and/or elections. Protests must be in writing and addressed to the Chairperson, Local 372 Election Committee, 125 Barclay Street, New York, New York, 10007. All objections to an election must be filed with the Election Committee Chairperson within ten (10) calendar days from the date of elections. All decisions of the Election Committee, protests as to election procedure of eligibility rulings, are subject to the approval or rejection of Local 372’s membership. Decisions of the membership shall be appealable to AFSCME’s Judicial Panel under Section 4 of Appendix D to AFSCME’s Judicial Panel within ten (10) days following the membership’s decision or forty (40) days after the protest was filed if no decision has been reached by the membership.
